Article 1 – Applicability

1. These general terms and conditions apply to all offers, orders and agreements made through Luxaloo's webshop (hereinafter: "seller").

2. "Buyer" is understood to mean any natural person (consumer) or legal entity (business customer).

3. All agreements are governed exclusively by Dutch law. The Vienna Sales Convention (CISG) is excluded.

Article 2 – Formation of the agreement

1. The products on the website do not constitute a binding offer, but an invitation to place an order.

2. By placing an order, the buyer makes a binding offer.

3. The agreement is concluded as soon as the seller confirms the order by email.

Article 3 – Prices and payment

1. All prices include VAT and are stated in euros.

2. Any shipping costs will be stated separately.

3. Payment must be made in advance using the payment methods offered.

4. In the event of late payment, the buyer is in default and the legal rules regarding collection and interest apply.

Article 4 – Delivery

1. Delivery takes place at the address specified by the buyer.

2. Stated delivery times are indicative and not binding.

3. The risk of damage or loss passes at the time of delivery to the buyer.

4. If a product is not available, the buyer will be informed as soon as possible and the amount paid will be refunded.

Article 5 – Retention of title

The delivered products remain the property of the seller until full payment has been made.

Article 6 – Right of withdrawal (consumers)

1. Consumers have the right to withdraw from the agreement within 14 days without giving reasons.

2. The cooling-off period starts on the day on which the buyer or a third party designated by them receives the product.

3. Withdrawal can take place via a clear statement by email or via the model form (see below).

4. After withdrawal, the product must be returned within 14 days.

5. The costs for return shipping are for the account of the buyer.

6. The seller will refund all payments received (including standard shipping costs) within 14 days of withdrawal, provided the product has been received or proof of return has been provided.

7. Exclusion of the right of withdrawal applies to:

Hygienic products whose seal has been broken;

Personalised or custom-made products;

Second-hand clothing with normal signs of use, unless there is a defect.

Article 7 – Condition of the products

1. New clothing:

Is delivered in new condition;

Complies with the legal requirements for conformity.

2. Second-hand brand clothing:

May contain signs of use;

Normal signs of use are not considered a defect;

The buyer acknowledges that the condition may differ from new products.

Article 8 – Warranty and complaints

1. All products are covered by the statutory warranty (product must meet reasonable expectations).

2. For second-hand products, the warranty period may be limited to 12 months, insofar as legally permitted.

3. Complaints must be reported within a reasonable period after discovery via support@luxaloo.com.

4. No right to warranty exists in the event of:

Normal wear and tear;

Damage due to incorrect use or maintenance;

Intentional damage or negligence of the buyer.

Article 9 – Liability

1. The seller is not liable for indirect damage, such as consequential damage or loss of profit.

2. Liability is limited to the amount of the purchase price, unless there is intent or gross negligence.

3. Nothing in these terms and conditions excludes liability for damage due to death or injury.

Article 10 – Intellectual property

All texts, images and other content on the website are the property of the seller and may not be used without permission.

Article 11 – Privacy

Personal data is processed in accordance with applicable privacy legislation (GDPR). See the privacy statement on the website for more information.

Article 12 – Disputes

1. All agreements are governed by Dutch law.

2. Disputes will be submitted to the competent court in the Netherlands.

3. Consumers can also use the European ODR platform: https://ec.europa.eu/consumers/odr

Article 13 – Final provisions

If a provision in these terms and conditions proves to be invalid, the remaining provisions will remain fully in force.
